If you have any connections with Susan Collin’s district in Maine or Joe Manchin’s in West Virginia, now is the time to use them. Using the incomplete FBI report as a shield, indications are that they’ll vote for Kavanaugh. Tell the supporters you know that there’s a different shield to hide under…other lawyers won’t touch him with a 10-foot pole after his maudlin performance at his nomination hearing.

After our national fire drill on Monday, it’s clear that we need Congress to protect the Mueller investigation. That’s a big ask of a Congress that’s proven its fealty to the President, but it’s absolutely important to pressure your members of Congress on this point.

Tues 9/18 – Judges shouldn’t lie under oath. Period.

Action – “Speak no evil” – Don’t reward liars with SCOTUS seats. 

Brett Kavanaugh has stated that he never assaulted Christine Blasey Ford. That he’ll repeat that claim under oath on Monday is expected, but of no importance, as he no longer has a reputation as an honest man to defend. With more information coming to light, testimony from his current hearing, as well as from his 2004 and 2006 hearings, have been re-cast as bald lies, alongside many statements that have been perjury-adjacent or “evasive”. He has been outed on the national stage as what he really is – a highly partisan political operative, and not the even-handed dispenser of impartial justice Americans deserve. His perjury under oath should immediately disqualify him from SCOTUS contention, as well as the federal bench he currently serves on.

Minimal Script: I’m calling from [zip code] and I want Senator [___] to do four things to prevent Brett Kavanaugh from ascending to the Supreme Court.

  • A) Require an FBI investigation as requested by Christine Blasey Ford prior to a full hearing of Brett Kavanaugh’s alleged actions against her. There is no longer a viable deadline.
  • B) Bring forward the two federal employees who had information regarding Kavanaugh’s witnessing of Judge Kozinski’s sexual harassment, contrary to his sworn testimony.
  • C) Subpoena all emails and messages between Kavanaugh and Kozinski, including links to his website, to determine Kavanaugh’s actual knowledge of sexual harassment issues as opposed to his statement under oath.
  • D) Start impeachment proceeding against Judge Kavanaugh for his continued perjury regarding stolen documents from his 2004, 2006 and current confirmation hearings.

Wed. 9/12: We don’t need another anti-environmental corporate-fanboy on the Supreme Court.

Action #1 – Call your senators to support them or chide them on the nomination of Brett Kavanaugh.

Brett Kavanaugh on the Supreme Court would do exactly what the Trump administration hopes he would do. Based on his record, he would wreak havoc on the environment to aid the administration’s largest donors, extractive industries like oil, gas, logging and mining, as well big agriculture. He will do it with “decisions” based on the strange, extreme, and absurd arguments that have puzzled and enraged his colleagues during his time on the federal bench. Now that the effects of global climate change are destroying parts of our country on a continual basis, we cannot afford another enabler of the polluters that foul our environment and destroy our health.

Thurs 9/6: Kavanaugh v. health care (3 actions, including “NO” on S.3388)

Action #1 – Call your senators AND do any of these actions today.

Action #2 – Call your senators about Kavanaugh’s plan on killing healthcare access for millions of Americans. 

Judge Kavanaugh declined to answer a question from Senator Sheldon Whitehouse (D-RI) (who, BTW, rocked his opening statement), about whether he would uphold protection for those with pre-existing conditions. Based on his known record, there’s every reason to believe Judge Kavanaugh would be the deciding vote in overturning and gutting critical health care protections.

Minimal script: I’m calling from [zip code] and I want Senator [___] to protect healthcare access and vote “NO” on the the nomination of Brett Kavanaugh to the Supreme Court.

Background
He has already written extreme legal theories to overturn longstanding precedent to diminish the power of federal agencies to help people. As a D.C. Circuit judge, he has written dissenting opinions in three cases that could have undermined the Affordable Care Act (“ACA”) and jeopardized access to health care.

Seven-Sky (2012): This upheld the ACA’s requirement that individuals purchase health insurance as within Congress’s authority under the Commerce Clause. Kavanaugh claimed that the individual mandate was “unprecedented” as well as “jarring” and praised a judicial decision that would limit Congress’ ability to regulate commercial activity such as health care. His opinion was well-outside the legal mainstream at the time but echoed the beliefs of partisan political organizations working to undermine the ACA.

Priests for Life v. US Dept. of Health and Human Services: The D.C. Circuit court rejected a challenge to the ACA’s accommodation to the birth control benefit, which allowed certain religiously-affiliated non-profit employers to opt out of providing birth control coverage directly to their workers by submitting a one-page form notifying their insurer or the federal government of their objections. Guess who Kavanaugh sided with.

Sissel v. U.S. Department of Health and Human Services – Sissel v. HHS, 2015 rejected the claim that the ACA was unconstitutional because it was a revenue-raising bill, but failed to originate in the House of Representatives as required under the Origination Clause.  Judge Kavanaugh argued that the D.C. Circuit Court should consider a claim that the ACA was unconstitutional. His fellow judges described it as a ‘flawed’ ‘misread’ of SCOTUS precedent.”

Action #1 – Write a letter to Kavanaugh

Tell him to stiffen up, ditch his over-eager handlers, order the White House to release ALL of his writings. AND direct the committee to allow enough time for the papers to be properly examined.

Like the ones where he says it’s a “traditional exercise” of presidential power to ignore laws the White House views as unconstitutional, as he defended the controversial practice of signing statements prevalent in George W. Bush’s White House.

“I don’t have to call. My senator is already a Democrat.” Wrong.

(Slate) “If the Senate were currently on the brink of passing a bill that would ban abortion in much of the country, progressives would surely be swarming every congressional office—even those of conservative Republicans. Confirming Kavanaugh will have roughly the same effect, yet only a tiny fraction of the country seems especially upset about it. Roe is popular among Democrats and Republicans, and when it goes, Americans will take to the streets en masse. Their anger will snowball once they see the grim reality of abortion bans—the women arrested and imprisoned for exerting control over their bodies. (Nearly one in four women in the US will have abortion in their lifetime.) For now, though, they are watching the disaster unfold in slow motion, and few seem moved to even call their senators.”

We have four days. Despite potentially being the deciding vote in an upcoming legal battle about the President’s ability to be indicted while in office, Republicans are still largely on-board with confirming him without reading into his record all that deeply. Democrats are not sure we have their backs.

Due to recent revelations that have implicated Trump in federal crime, all ten Democrats on the Senate Judiciary Committee have called for a postponement of the Kavanaugh hearings that were set to begin on September 4th.  Instead, they are asking Chairman Grassley to hold a special meeting “to discuss a bipartisan, fair, and transparent process for moving forward.”
