Wed. – 8/15: Don’t give a gavel to David Porter.

Action #1 – Vote “Oh, God, NO” on David Porter for the Third Circuit

David Porter is so far outside the legal mainstream, much less the 21st century, that his own state blocked him from becoming a district judge. They were worried that he wouldn’t be able to fairly judge matters of civil rights, women’s reproductive rights, LGBTQ equality, environmental protection and workers’ rights. The basics. And so are we.

Wed. 5/30: Judiciary Day – Part 2 – Blow the whistle on Chuck!

Despite his highly controversial record, and despite home-state Senator Tammy Baldwin (D-WI) not returning a “blue-slip,” Michael Brennan was confirmed to the judiciary on a 49-46 vote.

Forgot exactly which horrible nominee Mr. Brennan was? Totally understandable. There are a lot of them now. Refresh your memory here.

Senator Chuck Grassley, (R-IA) Chair of the Senate Judiciary Committee, ignored Senate protocol for the second time and proceeded with Brennan’s nomination despite home-state objections. Which is so interesting, as he was such a strong supporter of blue slips just a few years ago, having used the blue-slip process to reject several nominees from President Obama. Wed. 5/30 – Judiciary Day – Part 1 – Heinous nominees and proof that party matters when it comes to justice.

#1a – “NO” on Britt Grant for US Court of Appeals for the Eleventh Circuit.

Britt Grant, who is on Trump’s Supreme Court shortlist in spite of having only served as a judge since last year, has been nominated for a lifelong spot on the 11th Circuit Court of Appeals.

And that could be a very long time, as she’s just 40 years old.

But already, this hard-right Federalist Society member has a record of defending unconstitutional restrictions on the right to choose and undermining the Voting Rights Act, along with fighting collective bargaining for public sector workers. According to AJI, she “represents an advocacy position that is extreme,” in that she has sought to weaken rights of women, persons of color, LGBTQ Americans, and workers, as well as environmental protections. This record raises serious questions as to whether she will protect critical constitutional rights and legal protections for all persons.”

There shouldn’t be a question here.

Mon. – 5/7: Our judges are the last barrier we have against injustice. Tell your senator that this matters to you.

#1 – Protest the End of the “Blue Slip” Process.

Trump is packing the courts with anti-labor, anti-women’s rights, anti-workers’ rights, anti-civil rights and anti-LGBTQ rights, right-wing judges. This week Senate Majority Leader Mitch McConnell and Judiciary Committee Chair Chuck Grassley aim to confirm multiple federal judges as quickly as possible. They have set up a week of votes and hearings starting May 7.

To speed the process, Grassley has abandoned the “blue slip” process whereby a Senator from a nominee’s state may block an appointment. The Judiciary Committee’s ranking member, Sen. Dianne Feinstein, strongly opposed this move in the case of Seventh Circuit nominee Michael Brennan, which is being pushed forward over the objection of his home-state senator Tammy Baldwin. Feinstein has noted that if Brennan is confirmed it would be the first time in more than 30 years that a circuit court nominee was confirmed over a home-state senator’s objections. Brennan’s is one of six circuit court nominations that could be voted on during the week. Meanwhile, there are reports that a hearing will be held Wednesday for Ninth Circuit (which includes California) nominee Ryan Bounds of Oregon, for whom neither Oregon senator has returned a blue slip signaling approval for the process to advance. This action on Bounds is “an unprecedented affront to the advise-and-consent role of senators”; no circuit court nominee has ever been confirmed over objections of both home-state senators.

Wed. – 5/2 This Koch-ster is coming up for a full Senate vote. Brevent Brennan from getting a lifetime seat at our expense!

Michael Brennan is coming up for a full Senate vote this coming for a potential lifetime appointment on the federal bench.

This comes despite the fact that Wisconsin’s Democratic senator, Tammy Baldwin, refused to turn in a blue slip for him due to his hard-right opinions.

(AFJ.org) “Brennan’s record and writings indicate that he holds a singularly troubling belief: that conservative judges should not follow precedents they disagree with. He has celebrated Supreme Court decisions that have weakened civil rights, and encouraged conservative judges to be more vigorous in overturning acts of Congress. He has called for unchecked executive power and sought to weaken rights of criminal defendants.”

Withholding a blue slip usually means the end of a nomination, but, as Baldwin noted in a letter earlier this year,  “President Trump’s nomination of Mr. Brennan disregards the longstanding, bipartisan process in Wisconsin that has informed the selection of federal judges in my state,” Baldwin said. “This is a particularly troubling step at a time when institutions and traditions of democracy seem under constant attack, and bipartisanship feels like a fading concept.”

But, Senator Baldwin, he’s got something much better than a blue slip from you…

He has heavy backing from the Koch brothers , the far-right corporatists that helped engineer the dark-money campaign behind the Neil Gorsuch Supreme Court campaign. At Brennan’s Senate Judiciary Committee hearing, he couldn’t even acknowledge fact-based racial bias in the justice system.

  • At 5:30 p.m., the Senate will VOTE on confirmation of Executive Calendar #624, Stuart Kyle Duncan, of Louisiana, to be United States Circuit Court Judge for the Fifth Circuit.

Kyle Duncan, a lawyer who has built a career around extreme positions against members of the LGBTQ community, has been nominated by Donald Trump for a lifetime appointment to the U.S. Court of Appeals for the Fifth Circuit. He has worked aggressively to eradicate LGBTQ rights, immigrant rights, reproductive rights, voting rights, and more. Mon. 4/16 – That’s a hard “NO” on Wendy Vitter

She would like a lifetime position on the  Federal Bench in the Eastern District of Louisiana.

It’s hard to imagine a worse judicial nominee than Wendy Vitter. She’s pushed fake science as fact when it suits her anti-abortion agenda, for example, championing baseless theories linking abortion and contraception to cancer and infertility. She won’t even say her opinion on Brown vs. Board of Education decision out loud. She has stated anti-immigrant views and has worked in a DA’s office which was accused of multiple instances of unconstitutional behavior.

Minimal Script: I’m calling from [zip code] to urge Senator [___] to oppose the nomination of Wendy Vitter.

More script if you want it: Her extreme fact-free anti-abortion views endanger our health, and her shocking refusal to disavow the segregation of schools puts her far outside the judicial mainstream. Vitter is a dangerous and unqualified nominee who shouldn’t be let anywhere near a federal bench.
