In our 2018 voter guide, we included this video, which starts with film of an incredibly courageous Christine Blasey Ford, who provided testimony about a Supreme Court nominee whose background investigation by the FBI was later proven to be a sham. Brett Kavanaugh, a Federalist Society member, would be elevated to the Supreme Court, where he has voting against a woman’s right to choose how her body is used, and against voting rights for all.
We are not the same voters we were in 2018 – we know more about the Federalist Society, the regressive legal fraternity that has gained ascendency under Trump and whose majority on the Supreme Court is now now threatening democracy itself (See Moore v. Harper) They, along with their corporate funders, are determined to send America back to the 1930’s, before social safety nets like Social Security and Medicare, before labor, environmental and product safety requirements, before civil rights were a guarantee.
We’d like to update this with a quote from the Los Angeles Times, which is apparently still living in another, more civilized time…”Uncontested retention elections and 12-year terms are meant to strike a balance between judicial independence — allowing justices to do their work free of popular sentiment or political partisanship — and accountability to Californians. Accordingly, voters should vote “yes” unless they believe a particular justice has demonstrated unfitness to continue serving.”
Seriously?
Has this august news organization missed how GOP-appointed judges, with conservative backup now installed on federal courts and the Supreme Court, are issuing outrageous rulings, hoping to get noticed when Federalist-Society-judge-promotion time comes around? They are now seizing border policy from the president, redefining discrimination in such a way that removes protections from the LGBTQ community, declaring whole sections of the government unconstitutional, including the Consumer Financial Protection Bureau, the SEC, and potentially the EPA, the National Labor Relations Board, the Federal Trade Commission. and most major social programs, including Social Security and Medicare.
Judges matter, but how does one decide? We check in with regressive fan clubs to see who they’d have rule us…: A judge that scores well on on the “Judge Voter Guide” is a ticking time bomb, a farm team for future Kavanaughs and Coney Barretts.

- Election Forum uses an “Activist vs. Constructionist” scale. Their rating is then averaged with an estimate of their qualifications.
- Right-wing judges are “constructionists”
- Activists” are those who “impose their own moral codes, political beliefs, and secular values in an effort to reshape our society and promote social engineering.” Hmmm…they don’t mention “religious values”…
- Judge Voter Guide uses the same “Activist vs. Constructionist” scale as the Election Forum, but 50% of their score comes from a candidate’s response to their questionaire, a veritable right-wing minefield of questions on home schooling, the right of Christian extremists to discriminate, and where they think life begins…
- Robyn Nordell’s “Judicial Recommendations“, uses both sources above and others.
- Craig Huey’s list, which appears the same as the Election Forum’s.


Unlike in Superior Court races, in which judicial candidates face off against one another, Supreme Court and Court of Appeal justices seek retention with without opponents. The voters’ job is to say either “yes” or “no” to each of them.

However, she must have finally returned it with pleasing answers, as she is now rated a 3-star {Retain].

Justice Collins was appointed by President Clinton as a United States District Court Judge for the Central District of California in 1994. She served as Chief Judge of the Central District from 2009 through September 2012. She is a graduate of American University, Howard University, and UCLA. | Collins’s story is unique in that not only did she come of age during the Civil Rights Movement, but she was also the granddaughter of a slave. To be only two generations removed from slavery is “very unusual for someone my age, now 71,” says Collins. She was born in Chester, Pa. in 1945. But both her grandfather and father married later in life, which explains her proximity to slavery. After being freed sometime in the 1860s, her grandfather, Furman Lawrence Brodie, worked his way through school, eventually becoming a minister and teacher. “He didn’t learn to read until he was 16,” says Collins. Collins was first inspired to pursue a career in law by her family’s strong tradition of public service. Originally Republican, she’s been a Democrat since 1994. I am unaware of any negatives. |

In February 2010, Governor Arnold Schwarzenegger appointed Grimes as an Associate Justice of the California Second District Court of Appeal, Division Eight. | She’s a registered Republican. She was rated as “qualified” back in 2005, and had some concerns at her hearing. One pro-“traditional values” (i.e., conservative) website has recommended her; on the other hand, the LA Times has also endorsed her. Given that, I did a bunch of searching to see if I could find anything of concern. I couldn’t. There’s also no concern that she’s a Trumpublican: the governors that appointed her would not be considered Republican by Trump today. I don’t think there is anything concerning here. |
