Action – Trump really wants to destroy OUR court, the Ninth Circuit. Thank our senators for their dissent and get people with other senators to call!
The Senate is in at 3 PM with a 5:30 PM vote on the motion to invoke cloture on the nomination of Daniel P. Collins to be United States Circuit Judge for the Ninth Circuit.
Collins’ bio on the Munger, Tolles & Olson website highlights his history representing Big Oil in climate cases: “Mr. Collins also successfully argued two major cases in the Fifth and Ninth Circuits that effectively brought an end (for the time being) to efforts to hold the energy industry liable in tort for injuries allegedly caused by global warming.”
Daniel P. Collins, a former associate deputy U.S. attorney general specializes in defending the oil industry in high-profile climate and environmental cases, including the current crop of climate liability lawsuits. One of his clients Royal Dutch Shell, is among the companies being sued by a group of California communities trying to hold oil companies accountable for climate change-related damages. Certain aspects of those lawsuits are already being appealed to the Ninth Circuit, which covers California, the Pacific Northwest as well as Alaska and Hawaii.
We think we’ve already bagged our limit on corporate shills. Continue reading “Mon 5/20: Urgent – Remind your senators that Daniel P. Collins should not be a judge.”
This is the notecard Bernhardt had to carry around to remind him of all his ethics recusals, and their expiry dates. (Western Values Project). These companies assuredly had a similar one. The picture of him is from memory and may not be accurate.
Action – Flood your senators’ office with calls to investigate oil lobbyist David Bernhardt’s BEFORE he becomes Secretary of the Interior.
David Bernhardt, a walking monument to conflict of interest, passed Senate Energy and Natural Resources Committee and is awaiting a confirmation vote by the Senate. As deputy secretary of the Department of the Interior under Zinke, he helped open our public lands and coastlines to mining and drilling, and his corruption machine is just getting warmed up. Already, Bernhardt’s calendar as deputy Secretary includes more than 150 entries over the course of a year that failed to mention either a description of the meeting topic or who attended, against reporting regulations, similar to his former boss Zinke.
But wait…! There’s more!

Update: It’s already here…
“Orderly and secure fashion” v. 1st amendment rights: The SCOTUS case involving Domineque Ray, a Muslim death row inmate and his request for an iman at his side during his execution should have been an easy lift. The Alabama Dept. of Corrections’ policy banning all but Christian clergy (what?!) in the execution chamber is blatantly unconstitutional. Alabama knew Ray’s faith since he was first imprisoned. Ray, however, didn’t learn of their exclusionary policy until a date arbitrarily decided to be “too late”. On a 5-4 vote, the Federalist Society members of the court put a state’s interest in keeping a tidy schedule over the 1st amendment rights of a minority prisoner. No matter what your views on capital punishment, or Ray’s guilt, this is a dangerous swipe against religious equality.
Action: Call against these judicial nominees!
Last Thursday, the Judiciary Committee advanced the nominations of 44 of Trump’s nominees to the main Senate floor. creep through the Judiciary Committee like a slow-growing cancer. You may think this issue doesn’t concern you because they don’t represent your area. Think indivisible, people! It’s within these horrors that Trump will be looking for his next Kavanaugh. We are all connected! CALL!

Action: Call against these judicial nominees!
Today, 40 terrible nominees who do not represent the values of the majority of Americans, will begin to creep through the Judiciary Committee like a slow-growing cancer. You may think this issue doesn’t concern you because they don’t represent your area. Think indivisible, people! It’s within these horrors that Trump will be looking for his next Kavanaugh. We are all connected! CALL!
Minimal script: I’m calling from [zip code] and I want Sen. [___] to know that she/he has my support to stop, in any way possible, this assembly line of inappropriate judicial nominees and the assault on the blue slip process and time periods for examining nominees.
More script if you want it (or email): All nominees with Federalist Society membership need to be opposed, but please concentrate on stopping the following: Chad Readler, Eric Murphy, Allison Rushing, Stephen Clark, Eric Miller, Daniel Collins, Kenneth Lee, and Daniel Bress.

We’ve had Sunday to mourn a loss. We KNEW there would be setbacks along the way. But unlike an actual battlefield, OUR TROOPS ARE STILL HERE! And we stand ready to march into voting booths and take power away from the criminals who’ve scrambled into our leadership.
In the meantime, Mitch McConnell thinks we’re sobbing into our sheets and is trying to push these new atrocities-in-suits through. Let’s surprise him…
Action #1 – Vote NO on Jeffrey Bossert Clark for Top Environmental Prosecutor
Clark was prominently involved in industry challenges to the EPA’s “endangerment finding” that set the scientific basis for all subsequent attempts to regulate greenhouse gases. Of course, Trump to make him the DOJ’s top environmental lawyer!
Minimal Script: I am calling from [zip code] to ask Senator [___] to vote NO on Jeffrey Bossert Clark for Assistant Attorney General for the DOJ Environmental and Natural Resources Division.
Additional Script if you want: Clark is a climate change denier whose opposition to environmental regulations and protections makes him unsuitable for the role of enforcing America’s environmental laws.
- The Sierra Club states that Clark is unfit to lead the DOJ Environmental and Natural Resources Division. (sierraclub)

Action #2 – Vote NO on Eric Dreiband for Assistant Attorney General
