Mon 7/30: “Ghost” guns, untraceable, undetectable, being made in a garage near you. Thanks, GOP! 5 actions to take now! This starts Aug. 1st.

Remember who allowed this to happen…

  • The day that metal detectors became useless.
  • The day that laws and restraining orders preventing the underage, the violent and the criminal from obtaining weapons became null and void.
  • The day the ability to trace weapons back to their source became moot.

…then do the 5 actions at the bottom.

This didn’t start yesterday: Five years ago, Cody Wilson, of Defense Distributed, published designs online for the “Liberator,” the world’s first 3D-printed handgun. The US Dept. of State office of Defense Trade Controls Compliance sued to block publication, arguing that they posed a national security risk and violated the Internation Traffic in Arms Regulations (ITAR). The government won the initial trial as well as the subsequent appeal.

Then, on June 12th, there was an inexplicable reversal of the government’s position and Defense Distributed won a settlement from Department of State that not only gave them a $40,000 payment for their legal costs, but restored their ability to legally distribute CAD files of firearms on its DEFCAD website. It also made their product, “Ghost Gunners“, a milling devices designed to turn 80-percent lower receivers into functional and untraceable weapons, far more profitable.

On Tuesday, Sen. Edward J. Markey (Mass.), joined by Sens. Bill Nelson (Fla.), Richard Blumenthal (Conn.), Chris Murphy (Conn.) and Dianne Feinstein (Calif.), all Democrats, sent a letter to Attorney General Jeff Sessions demanding that he explain the government’s decision to settle. The Brady Center has also just filed a Freedom of Information Act request to find out why the government settled.

GOP/NRA-backed legislation lights the fire…

What stopped them the first time? Defense Distributed pull their files off-line 5 years ago at the onset of the suit because of their fear of criminal and civil liability. Now, in combination with the “Protection of Lawful Commerce in Arms Act“, a GOP/NRA invention, this company, and their fan base can join major gun manufacturers in a consequence-free orgy of gun production and any mayhem that will follow..

Guns follow money… The Trump administration wants to make it easier for US gun companies to sell their firearms abroad, including AR-15’s. This would open a huge market for do-it-yourselfers along with the standard manufacturers. American guns that will be used against women and children. American guns that will be used against American soldiers.

This is the ultimate end game of the GOP/NRA. In fact, a GOP candidate from Missouri is giving away a device to print 3-D weapons. Austin Petersen’s campaign announced that it will raffle off the device as a show of the candidate’s support of the Second Amendment. “This technology has the potential to send gun control into the ash heap of history,” Petersen said. “The government’s ability to control or ban guns will be obsolete.”

What happens now?

Unless the government intervenes, schematics for 3-D guns will be available starting August 1st. Or earlier. Plans for the “Liberator” are already in circulation. Cody Wilson relaunched his website and his repository of 3-D printed gun models, will be available for anyone to download. Current export laws will allow them to freely sell plans for firearms under .50 caliber, including semi-automatic rifles like the AR-15. “What’s about to happen is a Cambrian explosion of the digital content related to firearms,” Wilson told Wired earlier this month.

Secretary of State Mike Pompeo has stated that he’ll review new policy on downloadable, DIY firearms. During a Wednesday Senate hearing on foreign relations, Senator Bob Menendez of New Jersey asked Pompeo, “Why on earth would the Trump administration make it easier for terrorists and gunmen to produce undetectable, plastic guns?” Pompeo told the committee that he’d “take a look at” the new policy.

On Friday, an emergency motion for a preliminary injunction against Defense Distributed was filed by the Brady Center to Prevent Gun Violence, Everytown for Gun Safety and the Giffords Law Center to Prevent Gun Violence. It failed.

Action #1 – Hold Pompeo’s feet to the fire.

Tell @SecPompeo to ! @StateDept http://everytown.org/3d

Sign this petition and this one.

Call or email, (or both!), Mike Pompeo at the State Department ask him to stop the 3D downloadable gun exemption.

Minimal script: I am a concerned citizen asking you to do the right thing and stop the special exemption allowing downloadable guns. This exemption makes it way too easy for guns to get in the wrong hands (terrorists, domestic abusers, felons, the mentally unfit). They have already been used to kill by those who were legally not allowed to own guns.
Please consider our safety first. Thank you”

Action #2 – Block the settlement state by state.

New Jersey’s Attorney General Gurbir Grewal last week sent Defense Distributed a letter claiming that making the files available to New Jersey residents would be a violation of state law. The company is countersuing. Let’s keep them really busy. Contact your attorney general and ask him/her to follow in Grewal’s footsteps.

Action #3 – Ask your legislators to block the settlement.

By 2019, people who own or create homemade firearms in California will have to apply for a serial number from the state and permanently affix it to the weapon. This won’t be enough. Ask your legislators to block the settlement and require that “receivers” now sold separately be identified with serial numbers.

Minimal Script:  I am calling from [zip code] to ask Rep. [___]/Sen. [___], that they take immediate action to block the settlement that the Justice Dept. has made with Defense Distributed and to create legislation requiring that gun “receivers” be required to have a valid serial number prior to sale.

Action #4 – Repeal the “Protection of Lawful Commerce in Arms Act”.

Fear of lawsuits for liability had stopped Defense Distributed before. Even anarchists can be forced to pay up in court.  If gun manufacturers are free to provide lethal instruments to use against us, we should also be free to sue them. To prevent it denies our freedom of speech as well as our inalienable right to live. Luckily, H.R.163 – Gun Manufacturers Accountability Act and  H.R.3984/S.1939 – Equal Access to Justice for Victims of Gun Violence Act are already on the books to repeal the “Protection of Lawful Commerce in Arms Act’.

Minimal Script for reps:  I am calling from [zip code] to ask Rep. [___]/Sen. [___], that they take immediate action to repeal the “Protection of Lawful Commerce in Arms Act’ by cosponsoring H.R.163 and H.R.3984.

(Neither Brownley or Carbajal have cosponsored these bills. Check these links H.R.163/H.R.3984 for yours.)

Minimal Script for senators:  I am calling from [zip code] to ask Sen. [___] to take immediate action to repeal the “Protection of Lawful Commerce in Arms Act’ by cosponsoring S.1939 – Equal Access to Justice for Victims of Gun Violence Act

(Thank Feinstein and Harris, they’re already on it. Check here for yours.)

Action #5 – If you think the GOP/NRA doesn’t have a goal of arming everybody, including “gifted 3-year olds”, watch this.

Thoughts and prayers, indeed.
