The “Employee Rights Act” (H.R. 2723) permits employers to count non-voters as “NO” votes in elections on union formation. The Workforce Democracy and Fairness Act (H.R. 2776) permits delays to elections that allow employers time to fill the voter rolls with anti-unionists.
