This rule will hit the regulations.gov website soon. In the meantime, tell your legislator that you want them to protect our legal immigrants’ rights to access healthcare and benefits. With dedicated xenophobic personnel like Steve Miller, the administration is regulating us into an immigration desert, and our legislators need to step up. When and if the rule is published for comment, that will be part 2.

Instead of solving urgent problems like health care access for all, making higher
education free, or saving us from a climate change melt-down, the administration is focusing their meager creative energy on new ways to abuse immigrants. There are stories that shock us, such as the deportation of the wife of a veteran and the threat of deportation against the legally adopted 4-year-old daughter of American citizens. We were angered by Jeff Sessions’ cruel ruling to deny asylum to those, mostly women and children, who are fleeing gang or domestic abuse. He is currently being sued by the ACLU. And many may not be aware that, at a time when war and climate change has displaced over 68.5 million people, the most since WWII, Steve Miller has been working diligently to slash our refugee acceptance rate to 45,000 and is going for 15,000, rejecting even the economic-benefits argument of our own government study, showing that refugees brought in $63 billion dollars more revenue than they cost over the last decade. (His own uncle is disappointed in him.) Now they’ve come up with another mean-spirited trick.

The Trump administration’s Department of Homeland Security (DHS) has proposed a policy to penalize immigrants and their US-citizen children for accessing a wide range of public benefits, including common tax deductions. When considering whether to provide applicants with immigration visas or legal permanent residency, DHS already penalizes immigrants who receive cash welfare payments. However, DHS is proposing to expand this rule and penalize immigrants who use any form of public benefit, from health insurance subsidies to the earned income tax credit used by about one-fifth of taxpayers. The rule, which was crafted by the notoriously xenophobic Stephen Miller, also penalizes immigrants whose US-citizen spouses or children use a public benefit. Under this new rule, immigrants would be disqualified from receiving a green card if they claim nearly any benefits or if DHS deems them likely to receive benefits in the future.
As is typical with the Trump administration, the reasoning for this proposed rule is utterly divorced from the facts. Rather than being a “burden” on the economy, immigrants pay billions in taxes, create new jobs and businesses, and use public benefits at the same rate as US-born people. Punishing immigrants for accessing basic government services will harm our communities and the economy and must not be tolerated.
